Software Licence Agreement
This agreement governs your use of MONOLITH, a paid iPhone camera app created by Rushabh Patel, trading as Atelier Patel. It explains the scope of your licence, what you can and cannot do with the app, how App Store payments are handled, and the limits that apply to warranties and liability.
1. Acceptance Of This Agreement
By downloading, installing, accessing, or using MONOLITH, you agree to this Software Licence Agreement. If you do not agree, do not use the app.
This agreement is between you and Rushabh Patel, trading as Atelier Patel, not Apple, except where App Store rules give Apple specific rights or roles. MONOLITH is licensed to you, not sold.
2. Licence Grant
Subject to this agreement and the applicable App Store usage rules, Rushabh Patel grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use MONOLITH on Apple-branded devices that you own or control.
This licence allows personal, lawful use of the app as a paid creative tool. All rights not expressly granted are reserved.
3. Restrictions
You may not, except where applicable law clearly permits it despite this restriction:
- copy, resell, rent, lease, lend, distribute, or sublicense MONOLITH;
- reverse engineer, decompile, disassemble, or attempt to derive the source code of the app;
- modify the app or create derivative works from it beyond what the law or any open-source component licence allows;
- circumvent security, licensing, payment, or technical protection measures;
- use MONOLITH in a way that violates the law, infringes another person's rights, or interferes with the service or software;
- make the app available over a network in a way that allows multiple devices or users to access it outside the App Store rules that apply to your purchase.
4. Purchases And Refunds
MONOLITH is intended to be sold as a paid download unless the App Store listing states otherwise. Pricing, taxes, supported territories, and any promotional terms are set out in the App Store listing shown to you at the time of purchase.
Apple, not Rushabh Patel, processes billing and payment for App Store purchases. Refund requests, purchase disputes, and payment method issues are generally handled under Apple's own terms and policies unless applicable law requires something different.
If MONOLITH later offers optional paid add-ons, feature packs, or subscriptions, those will be described separately in the App Store listing or in-app purchase flow when they are introduced.
5. Updates And Beta Features
MONOLITH may receive updates, fixes, compatibility changes, and feature revisions. Some features may be added, changed, limited, or removed over time, especially while MONOLITH is still expanding through beta and early public releases.
Access to beta builds, experimental features, or preview tools may be separate from your paid App Store licence and may be withdrawn, replaced, or changed without notice. Compatibility with older iOS versions or older devices is not guaranteed indefinitely.
6. Your Content
You retain ownership of the photos and other original content you create using MONOLITH. This agreement does not transfer ownership of your images to Rushabh Patel.
You are responsible for making sure you have the rights, permissions, and lawful basis needed for the images you capture, store, edit, export, or share. You are also responsible for your own backups and for using Apple or other storage systems appropriately.
7. Apple And Third Parties
MONOLITH is distributed through Apple's App Store, but Rushabh Patel is responsible for the app itself and for any support or maintenance obligations required by law. Apple is not responsible for MONOLITH's content, maintenance, or support beyond the roles Apple assumes under its own platform terms.
MONOLITH may link to or interact with third-party services, websites, or system frameworks. Those services are governed by their own terms and privacy practices. Apple and its subsidiaries may act as third-party beneficiaries of this agreement where the App Store rules require that outcome.
8. Privacy
Your use of MONOLITH is also subject to the MONOLITH Privacy Policy, which explains how personal information, diagnostics, support communications, and purchase-related context are handled.
9. Warranty Disclaimer
To the maximum extent permitted by law, MONOLITH is provided on an "as is" and "as available" basis. We do not promise that the app will always be uninterrupted, error-free, compatible with every device or workflow, or suitable for every purpose.
MONOLITH is a photography product. It is not designed, licensed, or intended for safety-critical, medical, navigation, emergency response, or other high-risk activities where failures could cause injury or serious harm.
Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you to the extent local law says otherwise.
10. Liability Limits
To the maximum extent permitted by law, Rushabh Patel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising from your use of or inability to use MONOLITH.
To the extent the law allows a cap, Rushabh Patel's total liability for claims arising from MONOLITH will not exceed the amount you paid for the app in the 12 months before the claim arose, or the minimum amount required by applicable law if that law requires more.
Nothing in this agreement limits liability that cannot legally be excluded or limited, including mandatory consumer protections that apply in your jurisdiction.
11. Termination
This licence remains in effect until terminated by you or by Rushabh Patel. It will terminate automatically if you materially breach this agreement.
On termination, you must stop using MONOLITH and delete all copies under your control, except to the extent continued possession is permitted through Apple's platform rules or required by law.
12. Consumer Rights
This agreement does not remove or reduce any non-waivable rights you have under consumer protection law. If the law where you live gives you additional protections, remedies, or guarantees, those rights continue to apply.
